Welcome to OGmont! These Terms of Service ("Terms") govern your use of the OGmont website, platform, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. About OGmont

OGmont is a digital agency and startup that provides software development, UI/UX design, web development, and app development services to other startups and businesses.

2. Account Registration

To use certain features of our platform, you must register for an account.

  • Authentication: You may register using third-party authentication (e.g., Google Login). By doing so, you authorize us to access specific information from that provider, such as your name, email, and profile picture.
  • Public Profiles: You may choose to populate a public profile on our platform. You are responsible for the accuracy of the information you share publicly.
  • Security: You are responsible for maintaining the security of your account. OGmont is not liable for any loss or damage arising from your failure to protect your login credentials.

3. Payments and Billing

  • Manual Payments: OGmont currently processes payments manually via QR code (UPI/Bank Transfer).
  • Verification: After making a payment, you must submit the required transaction proof to OGmont. Services or account upgrades will only be initiated once our team manually verifies the transaction.
  • Refunds: Due to the custom nature of design and development services, refunds are handled on a case-by-case basis as outlined in your specific project proposal or Statement of Work (SOW).

4. Intellectual Property

  • Client Deliverables: Ownership of the final code, designs, and deliverables created for your specific project will be transferred to you upon full payment of all respective invoices, unless otherwise stated in a specific SOW.
  • OGmont Platform IP: The OGmont website, underlying platform code, branding, and pre-existing intellectual property remain the sole property of OGmont.

5. User Conduct and Content

You agree not to use the Services for any unlawful purpose. You retain ownership of the data you submit to your public profile. However, by uploading content, you grant OGmont a license to display that content on the platform as intended by your account settings.

6. Limitation of Liability

To the maximum extent permitted by applicable law, OGmont shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data resulting from your use of the Services.

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Indore, Madhya Pradesh.

8. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you via email or a prominent notice on our platform.
